1. GENERAL CONDITIONS OF THE VEHICLE RENTAL CONTRACT
1.1 Company details.

1.2 Description and nature of the services and how they are contracted.
Globalia Automóviles SL is involved in the rental of vehicles without drivers for a minimum period of 2 hours up to a maximum period of 90 days within the national territory of Spain (Andorra and Gibraltar) under the brand "pepecar.com". It provides this service using its own vehicles and those of others under agreements with other operators which have provided evidence of all required authorisations and permits to provide such services.
These General Reservation Conditions may be complemented and/or supplemented by specific conditions for each service whenever the rental vehicle is the property of a third party operator or there are specific conditions relating to a particular promotion. As a result, the user (henceforth the client) undertakes to read the specific conditions applicable to each service prior to requesting and making use of the service.
Globalia Automóviles SL publishes details of the services it provides and the fees it charges on the website www.pepecar.com, in the network of authorised agencies, using the telephone line 807 41 42 43 (Maximum cost €1.16 euros per minute including sales tax from any fixed line telephone; €1.51 sales tax included from a mobile phone) and through commercial contracts between Globalia Automóviles SL with other companies and collaborators.
Globalia Automóviles SL accepts no responsibility for any and all damages that may occur as a result of technical incidents affecting the Internet, access to the Internet or the electronic aparatus from which the Internet is accessed and the reservation is made, and which could in any way affect the reservation (technical incidents in this context being understood to include but not be limited to interference, ommissions, interuptions, viruses, breakdowns and/or disconnections in the operational functioning of the system or IT equipment used by the client, etc). In any cases where a technical incident involves the online payment system, Globalia Automóviles SL accepts no responsibility for the incident, which is the responsibility of the financial institution that manages the online payment system.
For their part, the client is responsible for checking the contract once the reservation has been made in order to bring to the attention of Globalia Automóviles SL any possible incidents that may have occurred during the contracting process, so that any such incidents can be resolved without damage to either party.
1.3.- Treatment of confidential data.
The data protection policies of Globalia Automóviles S.L. comply with the legal framework established by Organic Law 15/1999 of 13 December 1999 on the Protection of Personal Data.
1.4 Legal and fiscal responsibilities of the client.
In general, the client is considered to be the legal person who is named as the first named driver on the rental contract. In cases where the contract is undertaken with a legal entity (such as a company or association) rather than an individual, said entity will take full nominal and legal responsibility for the contract. The aforementioned responsibility for the contract is without prejudice to the assumption of responsibility by the named drivers for any damage that could be suffered by Globalia Automóviles SL or third parties, whether through damage or through breach of road regulations that may occur, or through negligence in the use of the vehicle or failure to comply with any of the terms of the conditions contained in these present General Conditions and/or any specific contract conditions.
During the reservation process on the web page www.pepecar.com, the client must enter the details of the person responsible for making payment, should these details not coincide with the details of the person responsible for the contract. Should the full details of a company not be entered during the reservation process, the invoice will by default be prepared using the details of the first named driver. Should the details of the invoice have not been entered correctly when the reservation was made, the client can request the correction or modification of said invoice details by sending an email to atencion.cliente@pepecar.com or by telephone, calling 807.41.42.43 (Maximum cost: €1.16 per minute sales tax included from a fixed line phone; €1.51 sales tax included from a mobile phone). The request for modification of the invoice details will be processed by Globalia Automóviles, S.L. within a period of not less than 30 calendar days.
The client agrees to comply with all the terms and conditions contained in this document, and to inform each and every additional driver named in the contract of their obligation to comply with these terms and conditions.
1.5 Requirements for the contract
Minimum requirements for each and every driver:
FOR FOUR WHEELED VEHICLES: a valid, current driving licence which has been held for at least one year, and a minimum age of twenty-three (23) years old.
FOR TWO WHEELED VEHICLES: a valid driving licence which has been held for at least one year in the case of A1 driving licences, or three years in the case of B1 licences, or equivalent driving licences in the case of non European Union countries; in addition to a minimum age of twenty-three (23) years old.
This present contract shall not be agreed should any of the drivers included in it have had more than two accidents resulting in personal damage to the driver or vehicle, or damage to third parties of more than one thousand five hundred (€1500) euros; or should any of the named drivers have lost their driving licence in the last year, or been fined or detained for driving under the influence of alcohol and/or drugs in the last year.
In order to collect the vehicle, the client must present all relevant, current documentation for all named drivers, as detailed below, together with the credit card with which the reservation was made (except in the case of specific agreements between Globalia Automóviles SL and third parties).
1.6. Accuracy of information and data protection.
By signing the contract, the client is confirming that all data relating to themselves, and to all other drivers named in the contract, is accurate.
Should the client have given any false information, or have given misleading information that could give rise to mistaken interpretations, Globalia Automóviles SL may rescind the contract, and will not be obliged to repay any amounts paid, either partially nor in full. In addition, the total or partial waiver of excess contracted (extra damage cover) will cease to apply, and will leave the client exposed to unlimited liability to third parties and to Globalia Automóviles SL.
The client, the named driver and all additional named drivers authorise Globalia Automóviles SL to enter their personal details into their respective records, and to process them, whether automatically or not, for the management and recording of the transactions contracted by the parties. In addition, aside from the contractual relationship, the client gives permission for their personal data to be used by Globalia Automóviles SL for sending commercial offers and advertising by any means (post, telephone, fax, mailings and any electronic means), whether by Globalia Automóviles SL or by third parties. The client and the additional named drivers authorise Globalia Automóviles SL to provide their data to companies directly or indirectly linked to Globalia Automóviles SL and, in particular, to companies belonging to the Globalia Group, to which Globalia Automóviles SL belongs, for the use of sending advertising material and offers, whether by Globalia or by third parties. Should the client or any of the named drivers wish to access, rectify or cancel their data within the terms of Organic Law 15/1999 of 13 December 1999 on Data Protection, they should contact Globalia Automóviles S.L. by post at C/ Enrique Granados, Nº 6, Edificio A, Pozuelo de Alarcón, (Madrid, 28224), or by fax on 91 559 7033, or by e-mail at: atención.cliente@pepecar.com.
1.7.- Limitations to the service.
The client and/or the named drivers undertake to keep a copy of this rental contract in the vehicle for the duration of the rental period. In addition, the client and/or the named drivers undertake to inform Globalia Automóviles SL, or the breakdown and recovery service if this has been contracted, of any possible problem they detect, or of any damage suffered by the vehicle that results in it not functioning perfectly at the time that the damage occurs. In cases of breakdown or delivery of a replacement vehicle, Globalia Automóviles SL or the breakdown or recovery service will, on delivery of the vehicle, inform the client and/or the named drivers of how to proceed in the particular situation.
The client and/or named drivers will not undertake any journeys with the vehicle that would require its transportation by any other means of transport, such as ferries or trains. The client and/or named drivers undertake not to leave the national territory of Spain, Andorra and Gibraltar with the vehicle. It is further understood that cars hired in the Iberian peninsula may not be taken out of the peninsula. They may not be taken to the Balearic Islands, the Canary Islands, Ceuta, or Melilla, or out of the country. Likewise, cars hired on the islands may not be taken off the island on which they were hired.
Sub-rental of the vehicle, whether wholly or in part, is expressly prohibited. The client and/or named drivers are responsible, individually and collectively, for ensuring that no driver other than those named in the contract drives the vehicle.
The client and/or named drivers undertake not to drive the vehicle in any situations where it may not be safe to do so. It is forbidden for the vehicle to be overloaded, or to carry dangerous of flammable materials. Using the vehicle in any type of competition is strictly forbidden, and it may not be used to push or pull any other vehicle.
The client and/or named drivers undertake not to use the vehicle for advertising purposes using any type of external sign other than those placed thereon by pepecar, without the express consent (in writing) of Globalia Automóviles SL. In the event of non-compliance, Globalia Automóviles will apply the relevant penalty (see Annexes, Table of Additional Charges and other possible extras).
The client and/or named drivers undertake not to drive the vehicle on unsurfaced roads or surfaces, and also undertake to protect the vehicle against any meteorolgical conditions that could result in it being damaged.
The client and/or named drivers undertake not to use the vehicle negligently or in any way that would lessen its safety or performance, such as knocks to the underside, etc. (see annexes, Table of Damages and Excesses). Any damage resulting from these uses will not under any circumstances be covered by the vehicle’s insurance, enen should the excess waiver have been contracted.
The client and/or named drivers are jointly responsible for ensuring that the vehicle is not driven under the influence of alcohol or any other substance that affects the ability to drive, and for ensuring that no other drivers are permitted to do so.
The client and/or named drivers undertake to return the vehicle hired to the place from which they collected it (see annexes, Table of Damages and Excesses).
The client and/or named drivers undertake to return to the vehicle hired within the timeframe contracted (see annexes, Table of Damages and Excesses).
The pepemoto motorbike is a vehicle suitable for use in cities and surrounding areas. It may not be taken outside the Community of Madrid or the Province of Barcelona, as appropriate. Outside the aforementioned areas, pepecar shall not provide coverage of any type. The client shall be responsible for the full amount of any costs that might arise as a result of failing to comply with this clause (see Table of Damages and Excesses).
Clients who rent pepemoto motorbikes undertake to use the vehicle appropriately, which includes the following commitments:
In the event of these requirements not being complied with, the company is hereby empowered to charge the amounts established in the annexes hereto and the Table of Damages and Excesses, for repair of the damage caused to GLOBALIA AUTOMÓVILES SL.
1.8 Payment policy.
The contract becomes legally binding at the moment that it is confirmed by the company and the terms and conditions established in the contract are accepted by the client and/or payment is received.
The rental price, which depends on current rates as published on www.pepecar.com at the time of the contract (except in the case of specific commercial agreements between Globalia Automóviles S.L. and other companies or parties), includes:
The days of the rental period will be calculated using calendar days, for the purpose of calculating the rental payment, the duration of the contract and all extras and supplements contracted from www.pepecar.com (with the exception of specific commercial agreements with other companies or parties). For the purposes of the contract between the client and Globalia Automóviles SL, each day begins at the opening time of the office at which the service was been contracted, and finishes at the time that said office closes, except for cases where the rental period is less than one day.
Globalia Automóviles, SL offers their clients the possibility to contract a range of extras that are not included in the initial hire price when they contract the service, or through the modification of the contract through the sales channels described in this document, before the service begins or at the time that the vehicle is collected, with the exception of cancelation (depending on current rates published on www.pepecar.com at the time of the contract [with the exception of specific commercial agreements between Globalia Automóviles S.L. and other companies or parties]) The following extras are not included in the initial rental prices:
As the service is contracted by electronic means, Globalia Automóviles SL will not under any circumstances accept payment in notes and coins. The charges for vehicle rental over the Internet (whether directly via the Internet, via telephone, via internet in a travel agency or at the place of hire) cover:
The cost of rental of the vehicle.
The charge for preparing the vehicle.
The option of 100 km per day.
In addition, it is possible to contract via the aforementioned means the following options:
Maximum distance of 500 km per day.
Excess coverage for damages (includes breakdown assistance) – except in the case of motorcycle rental, for which this option is not available.
Breakdown assistance.
The cancellation option.
The other options which might be available depending on the type of vehicle contracted (baby seat, etc) shall be paid for by a current credit card in the name of the client (the same one as used for the contract itself) when the contract is made, or, in exceptional circumstances in which third parties are involved in the contracting, at the moment that the vehicle is collected.
Amounts due arising from the Week-End programmes of Viajes Halcón and Viajes Ecuador shall be paid for using the Week-End Plan vouchers at the moment that the vehicle is collected. Said vouchers cover:
Rental of the vehicle (including 500 km per day by default).
Breakdown recovery (this is included in the contract for all Week-End Plan contracts).
With all Week-End Plans, a charge of 10 euros will be made to a current credit card in the client's name (or that used for the contract if such be the case) for preparation of the vehicle and cleaning.
Optionally, with Week-End plan contracts, the client may contract, using a current credit card in their own name (or that used for the contract if such be the case):
The cancellation option.
Extra coverage for damages, either total or partial (all cases include breakdown assitance) – in the case of rental of Industrial Vehicles and Minibusses (8/9 seater), only the 2nd option is available: Partial extra coverage. This option is not available for motorbikes.
Any other option that might be available depending on the type of vehicle contracted.
Charges for rental through other agency networks include: rental of the vehicle with the default supplements included or contracted in each case. Payment will be made direct to the agency at the time the contract is agreed. When the client collects the vehicle, the client must present the valid contract or contract reference as proof of payment.
At the moment of collection of the vehicle, the client must provide the representatives of Globalia Automóviles SL. with the credit card – NEVER DEBIT CARD - used for the transaction (this is an essential requirement). Globalia Automóviles SL will charge the amount of one hundred and fifty (150) euros for cars and three hundred and fifty (350) euros for industrial vehicles and large minibusses (8/9 seater) to said card as a deposit, which will be collected should any of the following occur: supplementary charges such as non-covered damage, excess distance, delay in returning the vehicle or returning the vehicle to a point other than the one agreed or any other penalty (see annex, Table of Damages and Excesses:). Should the client not incur any additional charges, and on condition that the vehicle is not damaged in any way, the amount of the deposit will be credited, in full, to the credit card, following the completion of the rental period, within the period of time required by the financial institution responsible for managing payments and credits (never less than three days).
Should the vehicle be returned with damage of any form, Globalia Automóviles SL will not return the amount of the deposit and will charge the amount of the damages to the client’s credit card, basing the value of said damages on the amounts published in this document, as specified in the Table of Damages and Excesses: and/or, should such be the case, the difference between the two, until the whole supplementary charge has been covered.
On collection of the vehicle, the contract for reception of the vehicle will be presented and must be signed by the first named driver, thus accepting the general conditions of the service, and by the holder of the credit card, should they be different, accepting the conditions of payment, return and/or charge (depending on the case) against the deposit and any additional charges (damage and/or delay in the return of the vehicle) as appropriate at the time that the vehicle is returned.
1.9. Guarantee of Service
Globalia Automóviles SL undertakes to provide a vehicle that is in perfect roadworthy condition for safe driving. Should circumstances dictate that the company has to provide a vehicle that is not in ideal conditions to be driven, or there are no vehicles available, Globalia Automóviles SL will inform the client of this situation and must provide the client, to the extent that this is possible, with a replacement vehicle that is identical or superior to the one contracted, or return all monies paid.
1.10. Cancelation and Non-collection of the vehicle by the client.
The Client has the option to contract a cancellation option, the price of which is published in the list of available supplements on the web site, or through other commercial agreements signed with third parties. In the case of cancellation where the client has contracted the optional cancellation extra, Globalia Automóviles, S.L. will return 95% of the total value of the contract to the client, on condition that the client cancels before reception of the vehicle from Globalia Automóviles SL (in the case of specific conditions of third party operators, there is a minimum period of 24 hours for standard vehicles and 48 hours for people carriers and industrial vehicles).
Cancellation of the contract may be carried out by email to the customer service department of Globalia Automóviles S.L., atencion.cliente@pepecar.com, (this will not be effective until reception of confirmation in writing) or by telephone to 807.41.42.43 (Maximum cost. €1.16 per minute including sales tax from a fixed line phone; €1.51 per minute including from a mobile phone), or by contacting the travel agent through which the service was contracted. In the case of cancellation of the service via mail, there is a minimum cancellation period of 24 hours, without prejudice to the specific cancellation conditions of third party operators.
Should the client not have contracted the cancellation option Globalia Automóviles SL will not return any amounts already paid should the contract be cancelled or the vehicle not collected (with the exception of contracts agreed through commercial agreements with third parties that include such exceptions).
In order to make any modification to the contract originally agreed, the client should call 807.41.42.43 (Maximum cost. €1.16 per minute including sales tax from a fixed line phone; €1.51 per minute including from a mobile phone), or should contact the travel agency through which they contracted the service. In the case of contracts agreed through the Week-End Plan programme of Viajes Halcón and Viajes Ecuador, the client must use the aforementioned phone number or contact the offices of Viajes Halcón and Viajes Ecuador to make any changes.

2.2 DISTRIBUTION CHANNELS AND POINTS OF SALE:
The contract for rental of the vehicle can be organised using any of the following channels:
- The webpage of Globalia Automóviles SL, www.pepecar.com.
- The collection and return points of Globalia Automóviles SL in Madrid, Barcelona, Valencia, Seville, Bilbao, Valladolid and San Sebastian (or any other points that may open from which the service of vehicle rental is offered by Globalia Automóviles SL and not through a third party).
- The telephone sales line 807.41.42.43 (Maximum cost. €1.16 per minute including sales tax from a fixed line phone; €1.51 per minute including from a mobile phone).
- Networks of authorised travel agents.
- Through third party operators (Retail agents, tour operators, online agencies or other companies belonging to the commercial network through a specific commercial contract) that have a commercial agreement with Globalia Automóviles SL.
2.3.- CUSTOMER SERVICE:
Globalia Automóviles SL provides a customer service telephone helpline tel: 807.41.42.43 (Maximum cost. €1.16 per minute including sales tax from a fixed line phone; €1.51 per minute including from a mobile phone). This telephone helpline is managed by the Quality Department of Globalia Automóviles SL (Customer Service Centre).
2.4.- OBLIGATIONS AND REQUIREMENTS GOVERNING CONTRACTING THE SERVICE:
At the end of the rental period, should the client wish to make any complaint, they may contact Globalia Automóviles SL using

- Using the Telephone Helpline number 807.41.42.43 (Maximum cost. €1.16 per minute including sales tax from a fixed line phone; €1.51 per minute including from a mobile phone).
- Forms (Hojas de Reclamaciones) available in all of its Collection and Return points which the client can request if not satisfied with the service received. These Complaints Forms should be filled in at the Collection and Return Point. The client will receive two copies of the Form, with one copy remaining at the Pepecar Collection and Return Point where it was written, as established in applicable legislation.
The client undertakes to meet all requirements for driving the vehicle.
DOCUMENTS REQUIRED FOR COLLECTING A VEHICLE:
- Spanish National Identity Card (NIF/DNI) or ORIGINAL passport of the named driver in the contract and the holder of the credit card. Should the address on the contract be different to the address on the Spanish National Identity Card, proof of address (bank statement, electricity, gas bill etc which is not more than 6 months old) must also be provided.
- Driving licence – A CURRENT DRIVING LICENCE (ORIGINAL, NOT COPIES) OF ALL DRIVERS, VALID IN THE COUNTRY, SPAIN IN THIS CASE.
- The rental contract, a voucher from the travel agency or relevant reference number (locator/contract number) to identify the reservation.
- The ORIGINAL credit card to be used for additional charges, and the original credit card that was used to pay for the service, should the two be different (except for specific agreements between Globalia Automóviles SL and authorised third parties).
- A photocopy of the Spanish National Identity Card (DNI/NIF) of the holder of the contract, together with a written authorisation for the driver to collect the vehicle and to sign in the holder’s name to accept any possible additional charges.
- The original credit card that was used for the authorisation.
Globalia Automóviles SL reserves the right to request additional documentation or information to that listed above, should they consider it necessary to do so in order to reduce the risk of the contract not being fulfilled by the client. Should the client fail to meet any of the requirements listed above, Globalia Automóviles SL reserves the right to refuse to provide the client with the vehicle.
Should the holder of the contract (the holder of the card) NOT be one of the drivers, and cannot be present at the collection of the vehicle, the following documentation must be provided:
In the case of rental agreed through an Agency (as, for example, in the case of the Week-End programme of the travel agents Halcón Viajes and Viajes Ecuador) the client must also present the necessary vouchers for payment of the contracted vehicle rental.
In the case of rental contracts agreed through any means other than those listed above, the client must provide the relevant documentation for each case.
In the case of contracts organised through third parties (for example, travel agencies), the agency undertakes to inform the client of all the requirements and conditions established by Globalia Automóviles SL for providing the service, in accordance with the stipulations of relevant agreements that govern the contracting arrangement, absolving Globalia Automóviles SL of all responsibility should information provided prove inadequate or should there be any other cause attributable to the agency resulting in the service contracted not being provided.
2. 5 - JURISDICTION.
Globalia Automóviles SL expressly declines to submit to Transport Arbitration Committees (Juntas Arbitrales de Transporte) and all other arbitration procedures. Any disagreement that might arise between the client and Globalia Automóviles SL will be heard in Spanish courts or tribunals.

3.2.- ANNEX Nº 2: Table of DAMAGES AND EXCESSES.
Any damage caused to vehicles in the categories town, small, medium and large cars and people carriers during the rental period is divided in general and for purposes of cost into four categories:
CATEGORY 1 – CHARGE: 150 euros.
- Punctures, blows or cuts to the sides of tyres.
- Damage to locks. Damage to handles of doors, boot, etc (loose, broken or missing).
- Hub caps damaged (impossible to repair) or missing.
- Rear view mirror (interior and/or exterior) broken or missing.
- Broken or missing wheel trim.
- Front or rear windscreen wiper arms and/or blade broken or missing.
- hairs, accumulation of mud, cement, chewing gum on furnishings, vomit, traces of drinks on surfaces etc. This is a general list for guidance only and is not exclusive).
- Fixed side windows at front or back missing or broken.
- Blow to the bodywork of less than 10cm that has not broken the paintwork of the vehicle.
- Scratch longer than 5cm that has broken the paintwork of the vehicle.
- Scratches to the windscreen that can be repaired (without replacement).
- Missing or damaged child seat. (NOT INCLUDED IN THE EXTRA COVER FOR DAMAGE TO THE VEHICLE).
- Missing warning triangle, reflective jacket, tools, and documentation or instruction book for the vehicle. (NOT INCLUDED IN THE EXTRA COVER FOR DAMAGE TO THE VEHICLE).

Any damage caused to vehicles in the categories minibus (8/9 seater, minivan and small, medium and large vans (whether used for carrying loads, passengers or mixed use) during the rental period is divided in general and for purposes of cost into four categories:
CATEGORY 1 – CHARGE: 350 euros.
- Punctures, blows or cuts to the sides of tyres.
- Damage to locks. Damage to handles of doors, boot, etc (loose, broken or missing).
- Hub caps damaged (impossible to repair) or missing.
- Rear view mirror (interior and/or exterior) broken or missing.
- Broken or missing wheel trim.
- Front or rear windscreen wiper arms and/or blade broken or missing.
- Requirement for professional interior or exterior cleaning as a result of excessive soiling. (animal hairs, accumulation of mud, cement, chewing gum on furnishings, vomit, traces of drinks on surfaces etc. * This is a general list for guidance only and is not exclusive).
- Fixed side windows at front or back missing or broken.
- Blow to the bodywork of less than 10cm that has not broken the paintwork of the vehicle.
- Scratch longer than 5cm that has broken the paintwork of the vehicle.
- Scratches to the windscreen that can be repaired (without replacement).
- Missing or damaged child seat. (NOT INCLUDED IN THE EXTRA COVER FOR DAMAGE TO THE VEHICLE).
- Missing warning triangle, reflective jacket, tools, and documentation or instruction book for the vehicle. (NOT INCLUDED IN THE EXTRA COVER FOR DAMAGE TO THE VEHICLE).

ANNEX Nº 3: SPECIFIC CONDITIONS FOR PROMOCAR (VEHICLES WITH PUBLICITY)
Globalia Automóviles S.L. has a number of vehicles specifically designed for urban and surrounding areas. These may not be taken out of the urban or metropolitan area of the city from which they were collected, in accordance with the publicity related to this offer. Globalia Automóviles S.L. does not provide insurance coverage outside these geographical limits; outside these areas the client has unlimited responsibility to Globalia Automóviles S.L. and/or third parties.
At times, according to the promotion, Globalia Automóviles may demand a minimum number of kilometres per day. Should this minimum distance not be met, the difference between the kilometres travelled and the minimum for the promotion will be charged at €0.16 per km against the deposit or credit card used for the transaction.
Damage or disappearance (either total or partial) of the publicity stickers on the vehicle during the rental period will be considered as Category 2 damage and charged at the rate of €300. Even should total or partial waiver of the excess have been contracted, this cost shall not be covered.
Special rental conditions for promotional vehicles:
The promotion is for a limited period of 10 consecutive days and shall not be extended under any circumstances.
The driver must drive a minimum of 45 km per day and a maximum of 100 km per day. Should the minimum not be met or the maximum exceeded, the difference in the number of kilometres will be charged at per km €0.16 km.
These offers are limited to a specific number of vehicles and depend on availability of the fleet.
The Smart car has been designed for driving around cities and surrounding areas. The driver may not leave the Madrid or Barcelona areas (depending on the location of the promotion), in accordance with the advertising objectives of the offer. Pepecar will not provide coverage outside these geographical limits, even should the supplement for Breakdown Assistance have been paid.
Damage or removal (either total or partial) of the publicity stickers on the vehicle during the rental period will be considered as Category 2 damage and a charge of €225 shall be made.
3.4.- ANNEX Nº 4. IN CASE OF ACCIDENT / SPECIFIC CONDITIONS FOR BREAKDOWN ASSISTANCE.
In the event of an accident, the client undertakes:
That the driver will fill out a complete accident report, including details of the parties involved in the accident, and any witnesses to it as necessary.
To inform Globalia Automóviles SL immediately, and, if required, inform the police with all required details of the accident and exact location of the vehicle.
Should the client not comply with these requirements, the contracted Breakdown Assistance may not be effective, leaving the client personally exposed to third parties and Globalia Automóviles SL. for all and any damages.
In case of breakdown, the client should contact the Assistance service which will be provided for this purpose.
The geographical area of the service is the national territory of Spain, Andorra and Gibraltar. The home address of the client is their address in Spain, or, in the case of non-Spanish residents, the Collection and Return point of Globalia Automóviles SL. from which they collected the vehicle.
The client has the option of contracting Breakdown Assistance, whether combined with the total or partial waiver of the excess or separately. The price per day is stipulated in the contracting documentation.
Should the client not choose the breakdown assistance option, they can still call the helpline number provided for such purposes, but will be subject to the availability and accessibility of said services and, should their request be accepted by the company providing the service, will be subject to the charges determined by the company providing the service.
3.4.1.-ASSISTENCE TO THE VEHICLE AND COVERAGE
Breakdown assistance is not unlimited, and is subject to the following:
3.4.1.1. Repair In Situ and Towing in the case of breakdown or accident
Should the vehicle be immobilised as a result of a breakdown, accident or robbery, and in all cases of immobilisation caused by loss or robbery of keys, punctured tyres, lack or wrong type of fuel, Pepecar Asistencia will provide towing services to the nearest Pepecar Agency, or the garage chosen by the Pepecar Agency, providing that it is not more than 20 kms from the closest Pepecar Agency.
3.4.1.2. Recovery of the vehicle
If the vehicle has suffered an accident that results in its leaving the road, Pepecar Asistencia will send the required resources to recover the car so that it can be driven again or towed.
3.4.1.3. Transportation of the occupants of the vehicle
Should it not be possible to repair the vehicle in situ, or on the day of the incident involving the Pepecar vehicle, Pepecar Asistencia will provide the client with the most appropriate means of transportation from the scene of the incident to the closest Pepecar agency to collect a substitute vehicle.
Should the client have the right to a substitute vehicle and, as a result of the nature of the service, said vehicle will be provided by a third party, the client will be responsible for the deposit for collection of the car together with any extras that may be incurred (extra distance, damage, fuel, etc.), which will be charged to the client’s credit card.
Should the client’s credit card not be operational at the time of renting the replacement vehicle, Pepecar Asistencia will provide an alternative solution, within the terms of these conditions, but, under no circumstances, a replacement vehicle.
Should it not be possible to move the client in a period of less than 24 hours, Pepecar Asistencia will be responsible for the real costs of Hotel occupation for the occupants of the vehicle to a maximum of 2 nights, and with a limit of €60.00 plus sales tax per person per day.
Clients of Pepecar have the right to a replacement vehicle from categories A, B or vans (always similar to the vehicle rented and subject to availability) with a maximum limit equal to the rental period of the vehicle that has suffered the incident or, should it be shorter, the repair period for the vehicle.
In the case of industrial vehicles (eg. Vans and Minivans), owing to the reduced supply of such vehicles, the period for providing the client with a substitute vehicle is 24 hours from the time of the incident. During this period, Pepecar will offer the client another vehicle with different characteristics if an appropriate industrial vehicle is not available at the time. Pepecar Asistencia takes no responsibility for the load that the vehicle might have been carrying at the time of the incident.
Efforts will be made to try to ensure that the replacement vehicle is a Pepecar vehicle, except in cases where, as a result of distance from the nearest office, this is impossible.
3.4.1.4.-ASSISTANCE TO OCCUPANTS
Assistance covers the client, the additional named drivers and the occupants of the vehicle. If the client is a legal entity, the client will be understood to be the first named driver. Hitchhikers and drivers who are not named are excluded from assistance.
1. Transfer or repatriation of the injured or ill.
a) The costs of ambulance transfer to the closest clinic or hospital.
b) Checks by its Medical Team, in contact with the doctor treating the injured or ill person, to determine the appropriate measures and best treatment to administer, and the most suitable doctor for final transfer to the most appropriate hospital or home.
c) The cost of transferring the injured or ill person, by the most appropriate means of transport, to the hospital prescribed or home.
If the Associate is admitted to a hospital that is not close to their home, Pepecar Asistencia will take responsibility, at the appropriate time, for the subsequent transfer home, with the means of transport always being chosen by the medical team treating the person and when the medical team deems fit.
2. Repatriation or transport of the other Associates.
When as a result of illness or accident, one of the Associates has been repatriated or transported as in the previous section, and this prevents the remaining Associates from continuing their journey by the means originally foreseen, Pepecar Asistencia will take responsibility for transporting them to their home or place of hospitalisation.
3. Repatriation or transport of minors.
Should the Associate repatriated or moved as described in the preceding sections be travelling alone in the company of children aged under fifteen years old, Pepecar Asistencia will organise and take charge of the return journey with a person or steward designated by the Associate to accompany the children on the return to their home.
4. Repatriation of a deceased Associate.
Should an Associate die, Pepecar Asistencia will organise the transportation of the body to a place of burial in Spain, and will take responsibility for associated costs. Said costs will include conditioning of the body post death in accord with legal requirements.
Costs of burial and associated ceremonies are not included.
Pepecar Asistencia will organise and take care of the return home of the other Associates, when they are unable to do so by the means initially planned.
3.4.2.-EXCLUSIONS FROM BREAKDOWN ASSISTANCE
In general all services not communicated beforehand to Pepecar Asistencia are excluded. In addition, the following situations, costs and derived consequences are excluded from the guarantee insured:
• The robbery of material, luggage and other personal objects from the vehicle, in addition to any accessories to the vehicle (reimbursement of any type of cost derived from these is excluded).
• Immobilisation of the vehicle through lack of fuel, refilling with the wrong type of fuel or loss or breakage of the key.
• The substitution of spare parts, materials, lubricants, fuel and other elements employed by Urgent Assistance.
• The costs of emergency repairs, towing or rescue of a vehicle that have not been requested from Pepecar Asistencia.
• Pepecar Asistencia will take responsibility for the insured vehicle and its occupants, not including luggage or merchandise being transported.
• The costs of dismantling, examining and repairing the insured vehicle.
• General costs related to the loading and unloading of objects being transported.
• Pepecar works on the basis of supplying its vehicles empty of fuel, and as a result will not reimburse the amount of fuel the vehicle might contain at the time of the incident.
• All costs related to restaurants, taxis, petrol and vehicle repairs, excepting those included in point 4.1- of these General Conditions, are excluded.
• Any accidents or breakdowns that occur off the normal roads, for example, on forest tracks, marshy ground, deserts and beaches.
• Those related to illegal removal of the vehicle.
• Accidents or breakdown resulting from negligence in the maintenance of the vehicles or the improper use of the vehicle (during the rental period in both cases), or from the vehicle having been modified in ways that are not approved by the Industry Ministry. In addition, all costs derived from accidents or breakdowns caused by participation in any type of competition or race are also excluded.
