1. CONTRACTING

1.1. Contracting.

1.1.1. The car rental contract may be entered into via the web page www.pepecar.com of Globalia Automóviles S.L., the network of authorised travel agencies, the telephone sales line 807.41.42.43 (maximum cost of this service is €1.20/minute), or by means of commercial agreements between Globalia Automóviles S.L. and other companies or collaborators.

1.1.2. The contract is formalised at the time of confirmation of the service, with the acceptance of the contracting party of the conditions, or of its payment.

1.1.3. The minimum rental period is two (2) hours in the case of the contract being made via the web. For any other channels for taking out contracts, the minimum rental period is one full day.

1.1.4. The maximum rental period is fifty-six (56) days, except for specific promotional campaigns in the case of the rental of promotional cars or those with advertising, or other specific agreements.

1.2. Charges.

1.2.1. Under no circumstances shall Globalia Automóviles S.L. accept payment in cash.

1.2.2. Charges when taking out a contract via the web (through internet directly, telephone, in an agency or at any of our branches): the amount for the rental of the vehicle, the charge for preparation, the option of 500 kms / day (optional), total or partial damage waiver + roadside assistance (optional), roadside assistance (optional), the cancellation option (optional) and other optional extras available shall be payable by credit card (the one accepted in each case) at the same time that the contract is taken out or, in exceptional cases in which third contracting parties are involved, at the time when the vehicle is collected.

1.2.3. Charges when taking out a contract via the Viajes Halcón and Ecuador Week-End Plan programme: the vehicle rental (which automatically includes 500 kms per day) is paid with Week-End Plan vouchers at the time of collecting the vehicle. The charge for preparation, total or partial damage waiver + roadside assistance (optional), roadside assistance (optional), the cancellation option (optional) and other optional extras available shall be payable by credit card (the one accepted in each case) at the same time that the contract is taken out or, depending on the kind of option and always subject to availability, at the time when the vehicle is collected.

1.2.4. At the time of collection of the vehicle, the contracting party must provide a credit card (the one accepted in each case), the presentation of which shall be required by the personnel of Globalia Automóviles S.L. ( see section 3.3. for further information). Globalia Automóviles S.L. shall charge to this card the sum of eighty (80) euros as a deposit and shall enforce it in the event that supplementary charges occur such as uninsured damages, extra mileage, late return, or return of the vehicle to a place other than that assigned, among others. In the event of not incurring any additional charge, the amount shall be refunded in full to the same card, after the end of the rental period, within a reasonable period of time. Should the amount of the supplementary charge exceed the above-mentioned deposit amount, Globalia Automóviles S.L., in addition to not returning the deposit, shall charge to the credit card provided the difference until the whole of the additional charge generated has been covered.

1.3. Drivers.

1.3.1. The natural person stated as first driver in the rental contract shall be considered as the contracting party.

1.3.2. The contracting party undertakes to comply with all the terms and conditions laid out in this document, and to inform and enforce compliance therewith on each and all of the additional drivers shown on the agreement. The contracting party shall be responsible to Globalia Automóviles S.L. and to third parties for any damage and offences that might be incurred by the other drivers.

1.3.3. Minimum requirements for each and all of the drivers: the possession of a driving licence for at least one year and minimum age of twenty-three (23).

1.3.4. This contract may not be concluded in the event that any of the drivers included therein has had more than two accidents in which they caused damages to themselves or others in excess of one thousand five hundred (1500) euros, or whose driving licence has been withdrawn in the last year, or who has been fined or arrested for driving under the effects of alcohol in the last year.

1.4. The rental price includes:

1.4.1. Rent of the vehicle, including VAT (including IGIC in the Canary Islands). With the exception of specific commercial agreements between Globalia Automóviles S.L. and other companies or collaborators.

1.4.2. Charge for preparation in accordance with applicable rates (See point 8).

1.4.3. Insurance cover for damage: the damage to Globalia Automóviles S.L. vehicles is covered by default by a franchise of nine hundred (900) euros or another concrete amount, depending on the model, with the exception of rentals handled in the Canary Islands or other commercial agreements between Globalia Automóviles S.L. and other companies or collaborators. Up to this amount, the contracting party is liable for damage caused to the vehicle should this occur. Should the contracting party wish to take out a total or partial (depending on the vehicle) exemption from this franchise (total or partial damage waiver or fully comprehensive cover for damage to the vehicle), he shall pay an extra amount per calendar day of rental, which may differ depending on the age of the contracting party and the drivers, and on the form of conclusion of the contract, according to the rates in force (See point 8). This amount is subject to changes in specific commercial agreements between Globalia Automóviles S.L. and other companies or collaborators.

1.4.4. Kilometre allowance of one hundred (100) kilometres per calendar day of rental. Should the contracting party wish to take out a Kilometre allowance of 500 kms per calendar day of rental, he shall pay an extra amount per day of rental in accordance with the rates in force (See point 8). In the case of a contract taken out through the Week-End Plan of Viajes Halcón or Ecuador, the Kilometre allowance of 500 kms per calendar day is not an optional extra and is included in the price of the rental. In contracts signed through other sales channels a different criterion may be applicable by virtue of commercial agreements between Globalia Automóviles S.L. and other companies or collaborators.

1.4.5. Collection and return is to the same branch in which the contract was taken out.

1.5. The rental price does not include:

1.5.1. Penalty for late return, which shall be charged in accordance with the rates in force (See point 8).

1.5.2. Excess kilometres. In the case that the contracting party has not taken out the option of 500 kms per day of rental or if the mileage is not unlimited, the charge for extra kilometres shall be applied in accordance with the rates (See point 8).

1.5.3. In the case of not having taken out total or partial damage waiver, the price of the rental does not include the damage to the vehicle caused during the rental up to the default limit of the franchise contracted or the contracted limit in case of partial waiver. See policy on damage in section 7 of this document.

1.5.4. Even in the case of having taken out total or partial damage waiver, the following damage is under no circumstances covered by the aforementioned waiver. When it occurs, the corresponding category of the damage policy is applied, without prejudice to Globalia Automóviles S.L. being able to charge the full amount until the total cost of the repair is met after its assessment by a service centre, or to require payment for it by any other method if it is not possible to charge it:

1.5.4.1. The damages caused to the underside of the vehicle are not covered in any circumstances, even when total or partial damage waiver has been taken out.

1.5.4.2. Filling up the car with the wrong fuel, even when total or partial damage waiver has been taken out.

1.5.4.3. The repair to a wheel using the wrong screws, even when total or partial damage waiver has been taken out.

1.5.4.4. The disappearance, removal or damage caused to optional extras such as baby seats, ski racks or similar, even when total or partial damage waiver has been taken out.

1.5.4.5. The disappearance, removal or damage caused to the stickers carried by the vehicles, whether they are for the own advertising of Globalia Automóviles S.L. (pepecar.com) or for any other company or product. Even when total or partial damage waiver has been taken out, the contracting party shall be charged with the corresponding amount according to the rates in force (See point 7).

1.5.4.6. The disappearance, removal or damage caused to the signs carried by the promotional vehicles or those with advertising, whether they are for the own advertising of Globalia Automóviles S.L. (pepecar.com) or for any other company or product. Even when total or partial damage waiver has been taken out, the contracting party shall be charged with the corresponding amount according to the rates in force (See point 7).

1.5.5. Collection after the time agreed, or return before the time agreed. In these two cases, Globalia Automóviles S.L. reserves the right to charge against the deposit or the credit card of the contracting party a penalty amount that shall be a maximum of 100% of the daily rental price at the prices in force at the time when this penalty is charged.

1.5.6. Any extra charge generated that is provided for in the aforementioned points shall be collected by Globalia Automóviles S.L., should it occur, against the deposit mentioned in point 1.2.4. or, in the event that the latter does not cover the total amount, against the credit card of the contracting party, in accordance with the rates in force (See points 7 and 8), on the basis of calendar days (in the case of late delivery), extra kilometres (in the case of excess of Kilometre allowance), the damage policy of Globalia Automóviles S.L. (uninsured damage), the assessment of damage by a car service centre (damage to the undersides of the car, negligence or others), or the daily rental price (collection after or return before the times agreed).

1.5.7. Fines imposed on the vehicle during the rental period. Should these occur, the entity issuing the fine shall be supplied with the details of the contracting party so that it may be redirected to his residence, and an additional amount for administrative expenses for handling it shall be charged against his credit card in accordance with the rates in force to be found in point 8 of this document for administrative expenses for handling.

1.5.8. The right of cancellation. Should the client wish to have the possibility of cancelling their contract, providing they do so before the agreed date and time of collection of the vehicle, and of receiving a partial reimbursement, the client has the option of taking out a cancellation option. See section 2.6. of this document for further information

1.5.9. The penalty, and the costs of recovery if they are applied, for not returning the vehicle to the Globalia Automóviles S.L. branch from which it was collected.

1.5.10. The expenses incurred in the event of breakdown or accident (vehicle tow, hotel, taxi, replacement car, etc), for whatever reason. For these purposes the contracting party has the option to contract, together with the total or partial damage waiver or separately, the provision of a roadside assistance service, the clauses of which he accepts by this agreement, and which may be found in point 4.20 of this document.

1.5.11. Expenses incurred by Globalia Automóviles S.L. in recovering unpaid amounts owing, such as barristers and solicitors fees, judicial costs etc.

1.6. Truthfulness of data.

1.6.1. The contracting party, through the conclusion of this contract, confirms that his data and those of the other drivers detailed therein are truthful.

1.6.2. In the event that any of the data should be false, or if the contracting party has supplied incorrect information that might lead to the wrong conclusions, Globalia Automóviles S.L. may terminate this contract, and shall not be obliged to refund the amount paid either fully or partially. Likewise, the total or partial damage waiver taken out shall cease to be valid and the contracting party shall be exposed to unlimited liability towards third parties and towards Globalia Automóviles S.L.

1.7. Personal data protection policy.

The contracting party and the additional drivers authorise Globalia Automóviles S.L. to include their personal data in the respective files, as well as for their use and processing, whether automated or not, for the management and registry of the operations entered into between the parties. Likewise, they also authorise, apart from the contractual relationship, the processing of their personal data for the remittance of commercial offers and advertising on any support (correspondence, telephone, fax, mailing or any other telematic support), belonging to the company or third parties, by Globalia Automóviles S.L. The contracting party and the additional drivers authorise Globalia Automóviles S.L. to assign their data to the companies linked directly or indirectly with Globalia Automóviles S.L. and, in particular, to the companies in the Globalia group of companies, to which it belongs, for the purpose of their personal data being processed by them, and so that they may send them advertising and commercial offers, either their own or from third parties. If the contracting party or any of the drivers wishes to access, rectify or cancel his data in relation to any of the provisions covered by Organic Law 15/1999, of 13 December, on Protection of Personal Data, the client may apply in writing to Globalia Automóviles S.L., C/ Enrique Granados, Nº 6, Edificio A, Pozuelo de Alarcón (Madrid 28224), or by fax to the number 91.559.70.33, or by e-mail to the address: atencion.cliente@pepecar.com.

2. CHANGE OR CANCELLATION OF THE CONTRACT.

2.1. Extension of the rental period.

The contracting party may extend the length of the rental period from the time when the contract is taken out, and providing they do so before the termination thereof, and shall remain subject to availability and authorisation by Globalia Automóviles S.L. The rental price may vary in respect of the initial contract terms and payment shall be made against the credit card at the time that the contract is extended. In the case of taking out a contract with the Week-End Plan, the price shall be the one published in said plan, and the amount shall be charged to the client's credit card (the one accepted in each case) when this extension is made.

2.2. Reduction of the rental period.

The contracting party may reduce the length of his rental period, without charge, but in no circumstances shall he be entitled to receive any refund for the reduction of the hours/days specified in his contract.

2.3. Adding or changing drivers.

The contracting party may add or remove drivers, or change the data of any of the drivers shown in the contract, providing this is done before the collection of the vehicle. Given that any change in the personal data may give rise to a modification in the amount to be paid for total or partial damage waiver, consequently there will be, in the event that this change takes place, an immediate charge against the credit card (the one accepted in each case) of the contracting party should there be the need to increase it. If the amount is less than that contracted initially, no refund shall be given.

Changing the total or partial damage waiver before collection of the vehicle.

This will give rise to changes in the financial terms of the contract, and for this reason the difference shall be charged in an identical way to that described in the previous point 2.3.

2.5. Changing the roadside assistance option.

This will give rise to changes in the financial terms of the contract, and for this reason the difference shall be charged in an identical way to that described in the previous point 2.3.

2.6. Changing the rental period.

If the client wishes to change the dates of collection and delivery originally contracted, he must pay an additional charge in accordance with the rates in force to be found in point 8 of this document (charge for change). This change must be made in all cases before the start of the rental period originally contracted. Given that the rental price may vary in respect of the initial contract terms, the client shall pay for the new services in accordance with sections 2.1 and 2.2.

2.7. Cancellation of the contract

2.7.1. The client has the possibility of taking out a cancellation option, the amount for which can be found in Point 8, or in the Week-End Plan book. Should he take this out, he has the right to cancel his reservation and receive 80% of the total amount thereof, providing that he does so before the collection of the vehicle in the installations of Globalia Automóviles S.L.

2.7.2. The cancellation may be effected via electronic mail to the customer service department of Globalia Automóviles S.L., atencion.cliente@pepecar.com, calling the telephone number 807.41.42.43 (cost of this service €1.20/minute +VAT), or applying to the travel agency in the case of having contracted the service via an agency.

2.7.3. Should the client not have taken out this cancellation option, Globalia Automóviles S.L. shall not refund any amount in the event of cancellation or failure to collect the vehicle.

2.8. The procedure for making changes to the original contract, is by means of the web page www.pepecar.com, following the specific instructions, or calling the telephone number 807.41.42.43 (cost of this service €1.20/minute +VAT), or through the travel agency through which the contract was made. In the case of a contract taken out through the Week-End Plan of Viajes Halcón or Ecuador, the procedure may only be carried out using the above-mentioned telephone number or through a Viajes Halcón and Ecuador agency.

3. COLLECTION OF THE VEHICLE

3.1. Place of collection.

The place of collection of the vehicle shall be that shown on the contract.

3.2. Time of collection.

Each branch may have different opening and closing times, which will be fully set out in the contracting system that the contracting party has used. The contracting party must always collect the vehicle during the opening hours detailed. Once the establishment is closed, it will not be possible to hand over the vehicles until the following day.

3. Documentation necessary for collecting the vehicle:

i. National Identity Document or ORIGINAL passport of the contract holder (holder of the card). If the address in the contract is different from that on the National ID, the client must provide proof of address (bank statement, electricity or gas bill, etc, not more than 6 months old).

ii. ORIGINAL VALID driving licence for ALL drivers.

iii. The rental contract or reference (contract number) in order to locate it.

iv. ORIGINAL credit card for additional charges, and ORIGINAL credit card with which the rental was paid should this be different.
Globalia Automóviles S.L. reserves the right to request information in addition to the aforementioned, should it deem it necessary or appropriate in order to reduce the risk of a breach of contract on the part of the client. In the event that the client fails to fulfil the above-mentioned requirements, Globalia Automóviles S.L. reserves the right not to proceed with the delivery of the vehicle.
If the holder of the contract (the holder of the credit card) is not one of the drivers, and is unable to be present at the collection of the car, the following documents must be presented:

v. Photocopy of the National ID Document/ Passport of the holder of the contract.

vi. Written authorisation for the driver to collect the vehicle and sign on his behalf the acceptance of possible additional charges.
In the case of a contract taken out through the Week-End Plan of the Halcón Viajes or Ecuador Viajes agencies network, the client must in addition have with him the necessary vouchers to pay for the rental of the vehicle previously contracted.
In contracts entered into through means other than those mentioned, the client must have with him whatever documentation is relevant in each case.

3.4. Photographs.

For the sole purpose of maintaining a suitable level of security, Globalia Automóviles S.L. shall take a digital photograph of each client at the time of collection of the vehicle. This digital photograph shall be used only in the event that the vehicle is not returned to Globalia Automóviles S.L. on the date agreed on, and the company has received no explanation from the contracting party.

3.5. Photocopy of the documentation.

Globalia Automóviles S.L. shall make photocopies of the documentation (National ID, passport, driving licence, credit cards, etc) that it considers appropriate, for the purpose of maintaining a suitable level of security when handing over its vehicles.

3.6. Inspection of the vehicle and acceptance of its condition.

The contracting party shall inspect the vehicle before taking it away and shall sign his acceptance of the condition thereof and the reading of its kilometres, and shall give his agreement.

3.7. Early collection.

Globalia Automóviles S.L. no entregará ningún vehículo antes del comienzo del periodo de alquiler establecido en el contrato, salvo que el contratante acepte aumentar el periodo de alquiler en su contrato y realice la ampliación a través del método estipulado (ver apartado 2.1, 2.2. ó 2.6. para más información), con el consiguiente aumento de precio según las tarifas vigentes en ese momento.

3.8. Late collection of the vehicle.

Should the vehicle be collected after the agreed period, Globalia Automóviles S.L. shall make no refund to the contracting party for the reduction corresponding to the delay in collection. Globalia Automóviles S.L reserves the right to impose a charge for the expenses of relocating this vehicle (see section 1.5.5. for further information).

3.9. Refunds.

In the event that the vehicle is not collected without the contract having been cancelled, the contracting party shall not be entitled to claim any refund.

3.10. Condition of the vehicle.

Globalia Automóviles S.L. undertakes to deliver a vehicle in perfect condition as regards driving and security.

3.11. In the event that, for reasons beyond the contracting party and the drivers, the vehicle does not prove suitable for driving, or there are no vehicles available, Globalia Automóviles S.L. shall inform the client of this situation and must provide the contracting party as far as possible with a replacement car of equal or greater size, or refund all the amounts paid.

3.12. Fuel.

Globalia Automóviles S.L. hands over the vehicle with a quantity of fuel in the tank sufficient to be able to drive to a petrol station nearby.

3.13. Globalia Automóviles, S.L. reserves the right not to hand over a vehicle in the event that, in the judgement of an employee of the company, the contracting party is not in a condition to drive, or fails to present the documentation necessary for collecting the vehicle.

4. DURING THE RENTAL PERIOD.

4.1. The contracting party undertakes to keep in the vehicle a copy of the rental contract at all times during the rental period.

4.2. The contracting party undertakes to inform Globalia Automóviles, S.L., or the road side assistance service, regarding any failure detected or damage suffered by the vehicle that might hinder its perfect running at the time that this occurs. Globalia Automóviles S.L or the road side assistance service shall on delivery of the vehicle provide the contracting party with instructions on how to proceed in such an event.

4.3. The contracting party undertakes not to take the vehicle outside Spanish national territory, Andorra and Gibraltar.

4.4. The contracting party shall not undertake journeys with the car that would require its transportation in other means such as ferries or trains. From this point it is understood that those cars rented on the Spanish mainland may not leave it. They may not therefore be transported to the Balearic or Canary Islands, Ceuta, Melilla, or abroad. Likewise, the cars rented on the islands may not be transported outside the island on which they have been rented.

4.5. It is expressly forbidden to sub-lease the vehicle in its entirety as well as any of its parts.

4.6. The contracting party is responsible for ensuring that no driver who is not shown on the contract drives the vehicle.

4.7. The contracting party undertakes not to use the vehicle in the event that driving is not safe.

4.8. It is forbidden to overload the vehicle or to transport inflammable or dangerous material.

4.9. The contracting party undertakes to ensure that the vehicle shall not be used for competitions of any kind, nor for towing or pushing other vehicles.

4.10. The contracting party undertakes not to drive the vehicle on unpaved roads or surfaces.

4.11. The contracting party shall not drive the vehicle under the effects of alcoholic beverages or any other substance that might affect his ability to drive, nor shall he permit any other driver to do so.

4.12. The contracting party undertakes to protect the vehicle from weather conditions that might cause damage to it.

4.13. The contracting party shall always use the fuel recommended by the manufacturer.

4.14. Once the car is rented, the contracting party must check and maintain the correct fluid levels and tyre pressure at least every three days.

4.15. The contracting party shall never modify or change the mark, the colour, nor the identification data of the vehicle or of its ownership.

4.16. In the event of theft, robbery or disappearance of the vehicle, the contracting party undertakes to:

4.16.1. Report the occurrence immediately to the police.

4.16.2. Present Globalia Automóviles S.L. with the police report filed and the key to the vehicle, while providing full details regarding the incident.

4.16.3. Globalia Automóviles S.L. shall not provide a replacement vehicle in the event of robbery or theft.

4.16.4. Should Globalia Automóviles S.L. consider that the vehicle has been taken due to the negligence of the client, the contracting party shall be liable for the whole of the loss to Globalia Automóviles S.L

4.17. In case of accident, the contracting party undertakes to:

4.17.1. The driver must fill in a full accident report, including the details of the parties involved in the accident, and eyewitnesses if this is necessary.

4.17.2. Inform Globalia Automóviles S.L. immediately and the police, if appropriate, providing all the necessary facts regarding the incident, and giving accurate information on the location of the vehicle.

4.17.3. Failure to follow this procedure may cause the cover of the insurance taken out to become invalid, and the contracting party may become personally liable to third parties and to Globalia Automóviles S.L.

4.18. In case of breakdown, the contracting party must contact the assistance service that shall be supplied to him for this purpose.

4.19. In the event that the contracting party fails to comply with any of the above-mentioned clauses (4.1. to 4.18.), the cover of the insurance may not be valid and, therefore, the contracting party shall have to be personally liable for any loss or damage caused to Globalia Automóviles S.L. or to third parties.

4.20. Road side assistance.

4.20.1. The contracting party has the possibility of taking out the option of road side assistance, either together with the total or partial damage waiver, or separately. The price per day is specified in the contracting method.

4.20.2. If the contracting party does not choose the road side assistance option, he may nevertheless call the telephone number supplied for the purpose, but shall be subject to the availability and accessibility of the aforementioned services, in addition to having to pay for them directly, should he accept them, to the participating companies at the rate that each might apply according to the case.

4.20.3. If the contracting party chooses the road side assistance, he accepts and understands that such attendance is not unlimited, but that it is subject to certain parameters set out below:

4.20.3.1. The assistance is only valid for incidents occurring in Spain, Andorra and Gibraltar.

4.20.3.2. By residence of the associate is understood his residence in Spain and, for non-residents of Spain, the Globalia Automóviles S.L. centre from which the vehicle was collected.

4.20.3.3. The assistance service covers the contracting party, the additional drivers and the occupants of the vehicle. In the event that the Associate is a company, the authorised driver shall benefit from the rights as an associate. Hitchhiker occupants are not covered by the highway assistance.

4.20.3.4. The assistance covers a vehicle that suffers from a breakdown or accident that prevents it from starting or continuing to run, but provides no cover in the event of theft or robbery of the vehicle.

4.20.3.5. The assistance covers the transport or medical removal of wounded and ill persons in ambulance to the nearest clinic or hospital.

4.20.3.6. The assistance covers the towing, in the event of accident or breakdown that might prevent the vehicle from moving under its own propulsion, as far as the repair workshop indicated by Globalia Automóviles S.L., provided that the distance is approximately equal to the nearest official workshop of the manufacturer of the vehicle. This service is limited to the costs of transport, with the exclusion of any other, such as spare parts, repair guarantee, shipment of luggage, etc., up to a limit of €180.

4.20.3.7. Alternatively, the assistance covers the costs entailed in an emergency repair (less than 30 minutes), undertaken on the site of the accident and that allows the vehicle to continue running, expressly excluding the costs of the parts that will be for the expense of the contracting party, who may later request their refund, only in the case of breakdown, from Globalia Automóviles S.L., which shall subsequently assess the origin of the breakdown and, if it was not provoked intentionally, or by misuse, shall proceed with the said refund. In the event that the breakdown was caused intentionally, or by misuse, by the contracting party or any of the drivers, Globalia Automóviles S.L. shall make no refund whatsoever.

4.20.3.8. The assistance covers the service of recovery or rescue of the vehicle which, while travelling on public roads, becomes immobilised, due to overturning or falling down a slope, and unable to run under its own propulsion, until it is returned to a place suitable for driving or towing and up to the maximum limit of €121.

4.20.3.9. When the accident giving rise to the assistance occurs on the motorway and it is not possible to make contact with the assistance telephone line, the motorway SOS service must be used. Likewise, if the accident occurs in a place or in circumstances in which the request for assistance is unviable, and an unsolicited tow-away truck arrives at that location, before making use of the service the removal of the vehicle to the operations base of said tow-away truck must be agreed on and once there, the assistance telephone number must be contacted.

4.20.3.10. When the vehicle immobilised outside the province of residence of the contracting party cannot be repaired the same day and its repair entails more than 8 hours according to the manufacturer's rates the assistance insurance shall cover the actual expenses of a stay in a hotel in the same locality as the repair, category three stars or equivalent and day up to a maximum of 2 nights.

4.20.3.11. When the vehicle cannot be repaired within the 48 hours following the breakdown or accident and its repair entails more than 6 hours according to the manufacturer's rates, and provided that the contracting party has not made use of the previous guarantee, the assistance insurance covers the transport or return of the contracting party and the occupants, as far as their residence in Spain or, at their choice, to the place of destination of their journey in Spain, providing that in this latter case, these expenses do not exceed those of their return home.

4.20.3.12. In the event that the vehicle cannot be repaired on the day (immobilisation of 24 hours) and at the place of the accident, the assistance insurance will provide the contracting party with a replacement vehicle for the vehicle's maximum rental period of Globalia Automóviles S.L. and the immobilisation of the broken down vehicle. This guarantee is subject to the availability of vehicles existing in the area of the accident using the vehicles belonging to Globalia Automóviles S.L. when schedules and proximity of its centres permits this or of another alternative supplier (vehicle type A or B).

4.20.3.13. When the vehicle needs repair that entails more than 72 hours of immobilisation or 8 hours of repair, the insurance covers the transport costs of the vehicle to the closest Globalia Automóviles S.L. branch and the costs of garaging or custody relating to the transported vehicle, up to a maximum limit of €121. The assistance insurance does not cover other transport costs, such as shipment of luggage.

4.20.3.14. The assistance insurance covers the transmission of urgent messages entrusted to it by the contracting party sent to his relatives or companies in Spain when for whatever reason they cannot be sent directly.

4.20.3.15. The assistance insurance does NOT cover the costs of hotel and restaurant, taxis, petrol, repairs to the vehicle (except those contemplated in the aforementioned points), the robbery of luggage, material, personal objects or accessories forming part of the vehicle.

4.20.3.16. The assistance insurance does NOT cover those costs of emergency repairs, towing or rescue of the vehicle that have not been requested from the assistance service.

4.20.3.17. The assistance insurance does NOT cover the costs inherent in stripping and examination of the vehicle.

4.20.3.18. The assistance insurance does NOT cover the immobilisation of the vehicle due to tyre punctures, lack of spare tyres, lack of fuel or loss of keys.

4.20.3.19. The assistance insurance does NOT cover the cost of the spare parts, materials, lubricants, fuel and components used in the mechanical emergency attendance service.

4.20.3.20. The assistance insurance does NOT cover the accidents or breakdowns occurring when driving off public roads, forest tracks, marshy areas, deserts and beaches.

4.20.3.21. The assistance insurance does NOT cover the unlawful robbery of the vehicle.

4.20.3.22. The assistance insurance does NOT cover accidents or breakdowns due to negligence in the maintenance or the improper use of the vehicle, or when the vehicle has been subjected to alterations not authorised by the Ministry of Industry.

5. RETURN OF THE VEHICLE.

5.1. Place of return.

The place of return of the vehicle shall be that shown on the contract.

5.2. Time of return.

Every establishment may have different opening and closing times, which will be fully set out in the contracting system that the contracting party has used. The contracting party must always return the vehicle during the opening hours detailed. Once the establishment is closed, it will not be possible to return the vehicles until the following day. If the vehicle is returned outside the times mentioned, the client shall be charged the penalty of one day for late return according to the rates in force (See point 8).

5.3. Late return.

In the event of late return of the vehicle, Globalia Automóviles S.L. shall make a penalty charge according to rates in force (See point 8). Likewise, it is possible that the cover of the insurance will no longer be valid on the date of completion of the rental contract, and for this reason the contracting party may in addition have unlimited liability towards third parties and to Globalia Automóviles S.L.

5.4. Early return.

Should the contracting party return the vehicle before the date and time of completion provided for in his agreement, Globalia Automóviles S.L. shall not refund a part of the amount paid. Likewise, Globalia Automóviles S.L. reserves the right to impose a charge for the expenses of relocating this vehicle (see section 1.5.5. for further information).

5.5. Inspection of the vehicle.

On returning the vehicle to Globalia Automóviles S.L., at the end of the rental period, the vehicle shall undergo a short process of inspection on the part of an employee of Globalia Automóviles S.L. This inspection is undertaken whenever possible in the presence of the contracting party. The contracting party shall sign his acceptance of the condition in which the vehicle is found and his agreement with the possible additional charges.

5.6. The contracting party shall be liable for the damage caused to the vehicle (depending on the type of insurance cover chosen and contracted for). The existence of this damage shall be assessed together by the contracting party and an employee of Globalia Automóviles S.L., and the contracting party is therefore obliged to be present at such an inspection.

5.7. In the event that the contracting party decides to leave before this inspection takes place, the contracting party must sign the return document in advance, thus giving his consent to the inspection taking place in his absence, and that in the event of any damage being found in the vehicle or there being any other additional damage, Globalia Automóviles S.L. may make the corresponding charge.

5.8. The contracting party accepts that, in the event that one of the authorised drivers returns the car without the contracting party being present, the acceptance on the part of above-mentioned driver, by means of his signature, of any damage or occurrence that might entail a supplementary charge, shall be an engagement to accept the possible charge against the deposit or the credit card of the contracting party.

5.9. Police report.

If the vehicle is not returned by the contracting party on the date agreed, Globalia Automóviles S.L. reserves the right to report to the police the fact that the vehicle is in the possession of the contracting party without its consent. Globalia Automóviles S.L. reserves the right likewise to bring a lawsuit against the contracting party demanding from him the payment of all the amounts of money owing and unpaid.

5.10. Failure to return to the branch agreed.

In the event that the vehicle is not returned by the contracting party to the branch of Globalia Automóviles S.L. agreed on, Globalia Automóviles S.L. shall recover said vehicle wherever it is situated, and shall charge the client with an amount according to the rates (See point 8). If the vehicle is not left at one of the branches of Globalia Automóviles S.L., the contracting party shall be charged with the penalty for failure to return to branch agreed plus the costs of recovering the vehicle.

5.11. Condition of the vehicle.

The vehicle shall be returned in the same condition in which it was collected, except for normal wear and tear due to use. If Globalia Automóviles S.L. considers that the dirty condition of the vehicle requires a more extensive cleaning than normal, the client shall be charged with the cost of this cleaning in accordance with the conditions set out in the policy on damages (point 7).

5.12. Fuel.

The contracting party it is not obliged to return the vehicle with a specific amount of fuel. This is with the exception of contracts handled in the Canary Islands or with other operators, and other private agreements that do not provide for this return.

5.13. Lost property.

In the event that the contracting party leaves any property behind in the vehicle, he may telephone the customer service department and request its return. The remittance costs shall always be for the account of the contracting party. Globalia Automóviles S.L., admits no responsibility for the loss of any object that the client might have left behind in the vehicle.

5.14. Loss or damage of key.

In the event that the contracting party loses or damages the key, he must contact the customer service department on 807.41.42.43 (maximum cost of this service €1.20/minute VAT included), to organise the collection of the replacement key. Globalia Automóviles S.L. shall charge the credit card of the contracting party with amount of one hundred (100) euros for the key, and the client shall be responsible for any possible remittance costs. If there are any additional costs, these shall be charged to the client via his credit card. Globalia Automóviles S.L. shall not hand over the second copy of the key without first having made the above-mentioned charges. If, when the car is returned, both sets of keys are handed in, the amount charged previously for the key shall be refunded, but in no circumstances the additional costs that have been incurred.

5.15.Globalia Automóviles S.L. will charge for the debt recovered with delay from customers an extra 5% of the total amount.

6. PROMOTIONAL AND ADVERTISING VEHICLES.

6.1. Globalia Automóviles S.L. has cars designed for driving in urban areas and their surroundings. It may not leave the urban or metropolitan area of the city where it has been collected, in accordance with the advertising interests of this offer. Globalia Automóviles S.L. shall not allow insurance cover outside these limits, and the contracting party shall have unlimited liability to Globalia Automóviles S.L. and/or to third parties.

6.2. Possibly, according to the promotion, a minimum number of kilometres per day may be required. In the event of not fulfilling this minimum mileage, the difference up to that minimum laid down for the promotion shall be charged at €0.14/km against the deposit or against the credit card supplied.

6.3. Damage or disappearance (total or partial) of the advertising stickers of the vehicle during its rental shall be considered as Category 2 damage, with a charge of €225. The total or partial damage waiver, even when it has been taken out, shall not cover this cost.

7. DAMAGE POLICY.

The damage caused to the vehicle during the rental is divided, for the purposes of the charge, into 4 categories:

CATEGORY 1.- A charge of 100 euros.
  • Puncture, cut or knock on the side of a tyre.
  • Missing tyre.
  • Steel wheel damaged (repair not possible) or missing.
  • Glass of wing or rear view mirror broken or missing.
  • Hubcaps broken or missing.
  • Burns or damage to the interior upholstery.
  • The vehicle requires professional interior cleaning.
  • Side window broken or missing.
  • Dent to bodywork (less than 10 cm in diameter) that does not crack the paintwork.
  • Scratch (over 5 cm) breaking through the paintwork.
  • Chip to windscreen that can be repaired (without replacement).
  • Safety triangle, reflective jacket or toolkit / first aid kit missing (NOT COVERED BY DAMAGE WAIVER).
  • Missing or damaged stickers on vehicle - not promotional material (NOT COVERED BY DAMAGE WAIVER).
CATEGORY 2.- A charge of 225 euros.
  • Alloy wheel damaged or lost.
  • Front headlamp broken or missing.
  • Rear light broken or missing.
  • Bumper broken (requiring replacement).
  • Dent to bodywork cracking the paintwork.
  • Broken, scratched or chipped front windscreen requiring replacement.
  • Broken rear windscreen.
  • Multiple points from Category 1.
  • Missing or damaged ski rack or child seat (NOT COVERED BY DAMAGE WAIVER).
  • Stolen, missing or damaged promotional material (NOT COVERED BY DAMAGE WAIVER).
CATEGORY 3.- A charge of 450 euros.
  • Impact to any panel.
  • Multiple points from Category 2.
CATEGORY 4.- A charge of 900 euros
  • Impact to any panel.
  • Structural damage to the vehicle.
  • Multiple points from Category 3.
  • Car filled with incorrect fuel (NOT COVERED BY DAMAGE WAIVER).
  • Incorrect wheel mounting using wrong screws (NOT COVERED BY DAMAGE WAIVER).
  • Damage to the underside (NOT COVERED BY DAMAGE WAIVER).

9. JURISDICTION

9.1. Globalia Automóviles S.L. expressly declines to be subject to the Juntas Arbitrales de Transporte (Transport Arbitration Councils), as well as any other arbitration procedures.

9.2. Any discrepancy that might arise between the contracting party and Globalia Automóviles S.L. shall be subjected to the Spanish Courts, with express waiver of any other court to which they might be entitled.
